1. The parties and accepted offer
This agreement is between the operator identified in the offer shown with these terms and the participating business identified in that offer. The person accepting confirms that they are authorised to bind that business. The accepted offer records the operator, business, subscription plan, fees, tax treatment and agreement version. The agreement starts when the business completes activation. An application or invitation alone does not create an active account.
2. The service
0TXT records sender-specific SMS marketing opt-outs and verified preferences on its voluntary register. It provides short unsubscribe links, a business workspace, CSV list washing, suppression exports and the other functions described in the accepted offer. A wash compares the business's submitted contacts with its existing suppressions and the active voluntary register. Continuous matching is available for contact mappings retained for that purpose. The business remains responsible for applying results in every relevant sending system.
3. Scope of an opt out
A sender-specific unsubscribe applies to SMS marketing from the named business across its lists and campaigns. By participating, the business also agrees to honour active voluntary-register matches for its own contacts. The register is a contractual preference service for participating businesses; it does not block mobile-network delivery, bind non-participating senders or replace statutory obligations. Essential messages may be sent only where lawful and must not be used to disguise marketing.
4. Applying requests before sending
The business must review new requests at least each business day, apply suppressions before the next marketing send, and meet every applicable legal deadline. It must wash the actual intended recipients immediately before each campaign and repeat the wash when a campaign is delayed or its recipients change. It must retain local suppression controls, including for messages sent outside 0TXT, and accurately report acknowledgement or application. A successful link creation or a report marked applied is not independent proof that the sending system has been updated.
5. Marketing permission remains the business responsibility
A result showing no 0TXT match, removal from the voluntary register, an account activation or a test reset does not grant marketing permission. The business must have its own lawful basis for sending, identify itself as required, provide a working unsubscribe facility, and honour requests received by any channel. It must not use 0TXT to solicit consent through an otherwise unlawful message or make an unsubscribe conditional on joining the voluntary register.
6. Authorised data and permitted use
The business may submit only contact information it is entitled to process for these purposes and must give any required notices. It must keep external IDs accurate and must not reassign an existing ID to a different phone. Results may be used to suppress marketing, operate the account and demonstrate handling of preferences. The business must not use results for audience discovery, enrichment, profiling, resale, number enumeration or marketing to registered people. It must not attempt to obtain the master register, its fingerprints or another business's records.
7. Privacy and security
Each party must handle personal information lawfully and protect it with measures appropriate to its role. 0TXT uses normalised numbers and keyed fingerprints for matching; where a full phone mapping is retained, it is encrypted separately. These protections do not make records absolutely anonymous. The business must protect its account and exports, limit access to authorised staff, and notify the operator promptly of suspected unauthorised access, misuse or inaccurate results. The operator must maintain reasonable access controls, backups and incident handling.
8. Service providers and communications
The operator may use disclosed hosting, SMS verification, email and support providers to operate the service. The current SMS verification provider is TouchSMS. The operator must keep the privacy notice and relevant provider arrangements current, including any applicable overseas-handling disclosures. Requested verification and operational account messages are used to operate the service, not to market to a person who has opted out. Optional notifications supplement the business workspace; delivery failures do not remove the business's duty to check and act.
9. Removal correction and retained suppressions
A verified number holder or authorised operator can remove a voluntary-register entry. That removal stops future global-register matches for that entry but does not reverse earlier business suppressions, create marketing consent or require other businesses to erase records they still lawfully need. The operator may correct errors and use explicit test-reset controls for controlled test records. The business must request a review of disputed records rather than silently treating a removal or reset as consent. Personal information is retained only while needed for the stated purposes or a lawful retention obligation.
10. Fees and billing
The fees, currency, billing period and GST treatment are those in the accepted offer. The initial pilot plans are A$5 per month or A$50 per year paid in advance, plus A$0.01 for each newly recorded business and phone suppression. Repeated requests for the same business and phone are not charged again merely because they occur in another list or campaign. Importing pre-existing suppressions does not create a new usage charge. A deliberate test reset can remove a test usage entry and a later new suppression can create a new one. Pilot invoices and payments are handled separately; the application does not itself charge a payment card.
11. Service availability and continuity
The operator will use reasonable care in providing the service and will communicate material interruptions where practicable. The pilot does not include an agreed uptime or delivery service level unless the accepted offer expressly adds one. The business must keep its sending-system suppression controls available during an outage and pause a campaign if it cannot confidently apply current opt-outs. Where practicable, the operator will maintain existing unsubscribe recording and suppression access during an account suspension or orderly closure.
12. Verification and fair enforcement
The operator may check business identity, the representative's authority and compliance with these terms, and may request proportionate evidence about handling of opt-outs. It may restrict new processing where reasonably necessary to address misuse, security risk, non-payment or a material breach. It will explain the reason and provide a reasonable opportunity to respond or remedy the issue, except where urgent action is needed to protect people or systems. A directory listing or alliance description means participation, not government approval or independent certification of every message sent.
13. Ending participation
The business may cancel renewal by contacting the operator before its next subscription period. The operator may end the service on reasonable notice, or for an unresolved material breach after a reasonable remedy period; urgent restrictions remain available under the previous section. The business must export and preserve the suppressions it needs, remove any claim of current participation when participation ends, and continue to honour existing opt-outs. If the operator ends a prepaid service period without the business's material breach, unused base subscription fees will be refunded proportionately. Any additional rights required by law are preserved.
14. Changes and renewal
The accepted version remains the record of the business's agreement. Material changes to fees, scope or these terms will be clearly notified before they apply, with a reasonable opportunity to decline renewal or end the affected future service. A fee change will not increase the base fee for an already paid subscription period without the business's agreement. Required legal or urgent security changes may be made when necessary, with an explanation and fair treatment of affected prepaid service. New agreement versions are recorded separately.
15. Responsibility and legal rights
Each party remains responsible for its own acts, omissions and obligations under this agreement. No provision excludes or limits a guarantee, right or remedy that cannot lawfully be excluded or limited. The service records and communicates preferences; it cannot promise that all unwanted messages will stop or that every participating business will comply. Any additional limitation of liability, indemnity or negotiated service level must be expressly agreed and must comply with applicable law.
16. Questions complaints and disputes
Send service or privacy concerns to the contacts in the accepted offer and the current privacy notice, with enough information to investigate without unnecessarily exposing personal data. The parties will first try to resolve a dispute promptly and in good faith. This does not prevent urgent relief or a complaint to an appropriate regulator or external body. Australian law and the law of Victoria govern this agreement, subject to any mandatory rights or jurisdiction that apply to the business or an affected individual.
